Mr Motif limited Terms & Conditions are as follows:

 

Use of photography & videography services

1. Scope of Services:

  • This agreement ("Agreement") is entered into by and between Mr Motif limited ("Photographer") and the undersigned client ("Client") for the provision of photography services as outlined in the project proposal or agreement.

2. Booking and Payment:

  • A non-refundable deposit of 20% from the agreed price of the service is required to secure the date for the photography project. The remaining balance is due one week prior to the scheduled date of the project.

3. Cancellation and Rescheduling:

  • In the event of cancellation or rescheduling by the Client, the booking fee is non-refundable. Cancellation within one week of the scheduled date may incur additional fees. The Photographer reserves the right to reschedule due to unforeseen circumstances such as inclement weather or equipment failure.

4. Copyright and Usage:

  • The Photographer retains copyright ownership of all images captured during the project. The Client is granted a non-exclusive license to use the images for personal or promotional purposes. Commercial use requires prior written consent and may incur additional fees.

5. Image Delivery:

  • Final edited images will be delivered to the Client in digital format within the stipulated date in the agreed contract. The Photographer is not responsible for the loss or damage of images during delivery.

6. Client Cooperation:

  • The Client agrees to provide necessary assistance and cooperation to the Photographer to ensure the successful completion of the project. This includes but is not limited to a suitable shooting environment, access to subjects, and adherence to the agreed-upon schedule.

7. Model Release:

  • The Client grants the Photographer permission to use the images for promotional purposes, including but not limited to online portfolios, social media, and marketing materials. If the Client does not wish to grant this permission, it must be stated in writing before the project date.

8. Liability:

  • The Photographer is not liable for any injury, damage, or loss incurred during the photography project. The Client is responsible for the safety and behaviour of all individuals participating in the project.

9. Force Majeure:

  • The Photographer is not liable for failure to perform due to circumstances beyond their control, including but not limited to acts of God, natural disasters, or government restrictions.

10. Governing Law:

  • This Agreement shall be governed by and construed in accordance with the laws of England & Wales. Any disputes arising under or in connection with this Agreement shall be resolved through negotiation, mediation, or, if necessary, through legal action in the appropriate jurisdiction.

11. Agreement Acceptance:

  • By signing the contract, the Client acknowledges that they have read, understood, and agree to the terms and conditions outlined in this Agreement.

Use of website

12. Intellectual Property

 

12.1

All content included on the website, unless uploaded by users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Mr. Motif, our affiliates or other relevant third parties. By continuing to use the website you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws

You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given express written permission to do so by Mr. Motif

Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday

Mr. Motif may from time to time send you information about our products and/or services. If you do not wish to receive such information, please click on the Unsubscribe link in any email which you receive from us, if for any reason you cannot find an unsubscribe link then please contact us and we can action this on your behalf

These Terms and Conditions and the relationship between you and Mr. Motif shall be governed by and construed in accordance with the Law of England and Wales and Mr. Motif and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales
